General terms and conditions of sale
The conditions stipulated below will come into effect between the parties only when the seller has confirmed the order and sent the buyer all of the conditions set out.

I.-COVERAGE OF OUR PRODUCTS
The use of this web platform, as well as any transaction carried out through it, is considered to be carried out in Spain and, therefore, is subject to current Spanish laws and regulations, all without prejudice to the legislation that may be applicable according to the condition of the consumer.
These General Terms and Conditions are intended to establish the regulatory framework for entering into the Contract. These terms and conditions will be supplemented, where applicable, by the corresponding Special Terms and Conditions.
As a Consumer, the Contract entered into is governed by the Spanish Royal Legislative Decree 1/2007 of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws (hereinafter referred to as, TRLGDCU).
II.- CONTRACTING PROCEDURE. HOW CAN I BUY ONLINE?
In order for you to access the products offered by MARK MADDOX and to make a purchase, you must freely and voluntarily provide the personal data that will be requested.
It is hereby informed that, in accordance with the requirements of Article 27 of Law 34/2002 on Information Society Services and Electronic Commerce, the contracting procedure will follow the following steps:

- If you wish to continue shopping, you must press the “continue shopping” button.
- Once you have selected the products you wish to purchase, as well as the number of units, you must click on “PLACE ORDER”.

The descriptions of the products offered on our portal are based on the MARK MADDOX product catalog.
The products we feature on our website are carefully selected from our collection. We have taken great care to accurately display the colors and features of our products. However, due to variations in the quality or resolution of monitors or devices used by users, it is important that you carefully review the product description on the purchase page, as it is not subject to these variations.

V.- PRICE INFORMATION

In case we detect a clear and verifiable price error for any product you have ordered, we will inform you immediately. In such a case, we will offer you the option of reconfirming your order at the correct price or, alternatively, canceling it if you prefer. This will take place before we send the order confirmation to the email address you provided, at which point the contract will be considered finalized, in accordance with applicable regulations.
VI.- SALES PROMOTION
The following will be considered sales promotion activities:

- Liquidation sales.
- Sales with a gift.
- Direct sales offers.
In all cases where our organization conducts any of the aforementioned sales, the announcement will specify their duration and, where applicable, any special rules governing them. The duration of each sale period will be determined at the organization's discretion.
In the case of items with a price reduction, the previous price will be shown along with the reduced price, except in the case of items put on sale for the first time.
If the advertised sales do not include the information set out in the preceding paragraphs, it will be understood, as indicated in these terms and conditions and in this section, that the price may vary depending on demand and is not subject to a specific timeframe or promotion. In other words, these will be the RRP (Recommended Retail Price).
In the case of sales with a gift or incentive, this may be delivered within the period determined by the sale without exceeding that established in each Autonomous Community/Region, which in any case will not be more than three months from the expiry date of the promotion.
VII.- SHIPPING COSTS
We do not charge shipping fees on any of our orders. All shipments are free of charge to the customer, regardless of the purchase amount.
Return shipping costs will only be charged if the customer returns a product for reasons not covered by the warranty. In such cases, the customer will be responsible for the return shipping costs, which will be clearly and transparently communicated to them.
VIII.- OFFER AND ACCEPTANCE
The procurement process and pre- contractual information are in Spanish. This is the language that will be used for all procurement procedures. If the process can be carried out in another language, this will be indicated before it begins.
IX.- INFORMATION ABOUT PAYMENT METHODS
Payment is made through the website at the time of purchase and MARK MADDOX will send you a confirmation email informing you of the expected date for receiving the product.
MARK MADDOX states that it does not have access to or store sensitive data relating to the payment method used by the User, except for that strictly necessary for its management. Only the corresponding financial institution processing payment has access to this data for the management of payments and collections. Once the purchase process is complete, an electronic document formalizing the contract is generated, which the user can print.

• What payment method can I use to make my online purchase?
Payment for products offered by the entity can be made through:
- Credit or debit card. Visa, MasterCard, Maestro. If your payment method is a bank card, by clicking "Order with obligation to pay" you are confirming that the credit card belongs to you. If you receive a notification that your card has been declined and you have verified that the card has not expired and that the information associated with your card is correct, you should contact your bank first to find out the reason for the decline or lack of authorization
- PayPal. If you choose PayPal as your payment method, once the order has been placed, it is not permitted to make any changes to the shipping address.

Once the order is placed, the company will confirm it immediately. These General Terms and Conditions will remain on this website and must be accepted by you before making payment.
Is it safe to enter my credit card details on the website?
As you can see in our security policy, our payment is secure using the indicated methods. You must notify MARK MADDOX via email or telephone, of any improper or fraudulent charges on the card used for purchases on the website, as soon as possible, so that MARK MADDOX may carry out the actions it deems appropriate.
• Billing information
The company generates invoices electronically provided you authorize us to do so at the final stage of the purchase. If you have not indicated your consent to receive the invoice electronically, we will provide you with a paper invoice along with your order, as this is the default format.
If you did not tick the box authorizing the issuance of the invoice in electronic format, but are interested in having it in that format, you can request it later through your user area if you are a subscriber to any of our company's products or by writing to the email address provided in these terms and conditions.
The invoice will be issued in the name of the individual or legal entity placing the order, so the User must ensure that the correct and complete details of the buyer are provided.
No further changes will be possible.
MARK MADDOX Please note that, to preserve data confidentiality, duplicate invoices will only be issued to the contract holder. Duplicates will not be issued to third parties.
X.- SHIPPING POLICY
• Delivery time
The maximum delivery time for products is 1 to 5 business days after payment has been received, according to the chosen method. If, for any reason, the order cannot be delivered within the established timeframe, we will notify you as soon as possible.
It is important to note that all delivery times mentioned are in business days and are subject to payment confirmation according to the selected method. In the event of any delivery delay, we will inform you promptly.
Please note that we do not deliver on Saturdays, Sundays or national, regional and local holidays.
• Delivery location
MARK MADDOX is committed to delivering the product in perfect condition to the address you have indicated, which must be located within Spain. To ensure successful delivery, it is important that the address provided is accessible during normal business hours.
It is important to note that MARK MADDOX assumes no responsibility if the product delivery is not completed due to incorrect, inaccurate, or incomplete information provided by the user. Furthermore, MARK MADDOX It will not be responsible in cases where delivery cannot be made due to causes beyond the control of the assigned shipping company, such as the absence of the recipient.
• Transfer of risk and ownership
Delivery is considered complete when the product has been made available to the User or a third party designated by the User (other than the carrier) at the specified delivery location. The risk of loss, damage, or theft of the products passes to the User upon delivery. However, if the consumer arranges for the transport of the goods or the chosen carrier is not among those offered by the company, the risk passes to the consumer upon delivery of the goods to the carrier, without prejudice to the consumer's rights against the carrier.
• Delivery problems
If there is any discrepancy or visible problem with the order upon delivery, you should not accept the delivery and should note it on the delivery slip or other document used by the carrier. Accepting an order with noticeable damage or defects may cause problems with its return. XI.- LEGAL GUARANTEE
• Right of withdrawal
In accordance with Article 102 of the General Law for the Defense of Consumers and Users (LGCDU), you have the right to withdraw from the transaction within fourteen calendar days , without needing to state a reason. A withdrawal form is available for this purpose .
In that case, in accordance with the provisions of article 108.1 second paragraph of the LGCDU, the shipping costs arising from the return will be borne by you .
How should I proceed to return a product?
- The products must be returned in the same condition in which you received them, along with any related accessories, and it is advisable to include a photograph of the condition of the product and the packaging.
- MARK MADDOX The company that will collect the product will inform you. The collection time will be approximately two business days.
- We will not accept returns sent freight collect under any circumstances.
Once we have verified that the products you are returning meet all the specifications of this policy, we will send you an email informing you that the return has been accepted.

• Refund
Regardless of the payment method you used , the refund will be processed as soon as possible, but always within 14 days of receiving the returned product at our warehouse. If you paid by bank transfer, please include your bank account details in the return form so we can process the refund.
• Out of stock
If all units of the purchased product are out of stock, Customer Service will notify you as soon as possible using the contact information provided during the purchase process. In this situation, MARK MADDOX undertakes to make the refund of the purchase amount immediately and, in any case, without undue delay.
XII.- MINORS
Access to and purchase of products on this website are reserved exclusively for people over eighteen (18) years of age, in accordance with Article 1263 of the Civil Code. If a minor wishes to purchase our products, the purchase must be formalized by their father, mother, or legal guardian, who will assume all contractual obligations and guarantee the veracity of the information provided.
